Counsel in product liability and toxic tort cases must keep one eye on an eventual appeal. But some issues make good appellate arguments while others do not, and preserving them for appeal can be a minefield. Focusing on issues that often arise in product liability and toxic tort cases, experienced trial and appellate counsel will discuss how to identify good appellate issues, the steps needed to preserve them, and strategies to weaken the other side’s appeal.
