As plaintiffs' attorneys look to expand liability against drug and medical device companies, eyes are increasingly turning to the sales representative. While the initial focus was on the "ghost in the OR," more and more, plaintiffs are making efforts to put the rep in the shoes of the surgeon and obliterate the protections afforded by the learned intermediary.
