This is Part 2 in a series addressing issues surrounding the attorney-client privilege and the persons or entities to whom duties are owed. The past decade has seen an explosion of litigation against a range of professionals under theories of liability involving third parties who may not fit the traditional definition of "client." This panel of private practice counsel will explore the expanding theories of liability by professionals to third parties, how those theories have fared in court, and what you can do to defend yourself and your client from inadvertent claims from third parties.
