Will We Ever Go Back to Normal? A Collaborative Conversation About the Impact of COVID on the Practice of Law and Litigation

Calling all IADC members: With the recent surge of the Delta variant, we can't seem to escape the pandemic, so we're hosting a collaborative conversation: Will we ever go back to normal? How has COVID impacted the practice of law in general, and litigation in particular, both short term and long term? What are the risks and best practices that have emerged for law firms and in-house legal departments as a result of COVID-19, including cybersecurity and data privacy risks inherent in remote workforces; the emphasized need to be responsive to client demands and budget limitations; and the challenges of reopening offices and returning to an in-person work environment?

We'll break into smaller breakout rooms so that moderators can encourage all attendees to share their experience and insights. In the final 10 minutes, we'll pull everyone back to the bigger screen where each group will report back to the full audience. Questions might include: (1) How has working remotely impacted your work culture? What do you miss? (2) Even if you're working from the office, you're undoubtedly interacting with others across the country who are working remotely - What benefits/drawbacks have you experienced with our new remote reality? (3) What parts of remote practice do you think might stick around long after the pandemic is over? Will clients insist on less travel and more meetings/hearings by Zoom? Will courts be more willing to allow witnesses/lawyers to appear by video rather than traveling? (4) Is it harder/easier to judge credibility by video than in person, and what safeguards can we implement? (5) How do you integrate new lawyers/staff when working remotely?

Key Takeaways:

1.  The global COVID-19 pandemic has presented a number of unique risk management issues for law firms and in-house legal departments. Identifying and responding appropriately to these issues is essential.
2.  Cybersecurity risk associated with a fully remote workforce must be addressed differently than the cybersecurity risks present before the onset of the COVID-19 pandemic.
3.  There are challenging employment-related issues that must be considered when reopening offices and requesting employees to return to an in-office work environment.

Learning Objectives:
