Defendants in litigation of all types are increasingly encountering suits financed by a third-party litigation funder. A litigation funder typically has no legal interest in the underlying litigation, other than as an investor providing financing in exchange for a percentage of any recovery. Rasch Brown will present an overview of this trend, focusing on the legality of such arrangements and the issues that practitioners may encounter, such as the discoverability of litigation funding arrangements, the effect of the collateral source rule on admissibility, and the applicability of state consumer credit laws.
