Courts are closed.  Hearings continued.  Civil jury trials are months away.  This is the legal world many are in given the coronavirus pandemic.  While cases were backlogged and courts were trudging along even before COVID-19, the slow pace to resolving disputes will now be exacerbated.  Yet, litigants and their advocates, alike, desire to move forward in disposing of their cases.  Therefore, now, more than ever, Alternative Dispute Resolution is the best way to resolve cases.
 
With Stay at Home Executive Orders in effect and social distancing expected of everyone, corporations, insurance carriers, and law firms have staff who are working from home.  Attorneys, company executives, and insurance professionals are not getting in automobiles, let alone airplanes, to personally attend meetings, settlement conferences, or negotiate cases.   Nevertheless, lawyers and clients who embrace technology can still effectively and efficiently – and safely – resolve cases during this pandemic through remote, online mediation and arbitration.

This Webinar will focus on:
  • The effect of COVID-19 on resolving litigated cases.
  • How arbitration can timely and fairly bring closure to on-going legal disputes, including matters currently pending in courts or agencies.
  • Ways in which mediation will allow parties to avoid the wait for judges to re-take the bench and, instead, satisfactorily settle cases with the aid of a skilled, well-prepared neutral.
  • The tools offered by arbitration and mediation, such as procedural flexibility and inherent confidentiality, which lead to fully enforceable agreements.
  • Harnessing technology to create safe forums for both mediation and arbitration without the need for in-person hearings, testimony, or caucuses.

Webinars are complimentary.  Please note that the IADC does NOT apply for CLE Credit for its Webinars. However, attendees are welcome to apply for and/or claim credit as their jurisdictions allow. Please contact your state accrediting agency for state-specific requirements and rules.
