Companies often prefer to defend litigation in federal court rather than its state court counterparts, as it generally offers a more streamlined process, greater predictability, and increased limits on runaway discovery, among other benefits. But getting to federal court is not always easy—or possible—and can require a nimble understanding of federal procedural doctrines to gain the benefits of federal jurisdiction that can potentially be outcome determinative. Snap removal is gaining more widespread acceptance but is not without risks. We will offer practical guidance to better understand when and how to effect snap removal to obtain favorable federal jurisdiction.
